When A Bankruptcy Loan Is Discharged

Author: Peter Gitundu

Bankruptcy is a situation in which an individual is not in a position to pay off his debts. As such, many will feel guilty and even give up when faced with this kind of position. It is important for people to know that it is not the end of the world when this happens to an individual. There are various options available when insolvency sets in.

First of all, the individual must look for an attorney to represent them in court. They must submit the financial statements of the past few months together with recent letters from the creditors. A bankruptcy loan is given to people who have filed for insolvency and a discharge has been given to them. This is done after the creditors have already been paid.

This is a channel for the debtors to start all over again financially. This financial help is a way for those who have previously been able to acquire assets such as automobiles and homes on credit pay up for them. For one to be granted a bankruptcy loan, it will depend on the chapter under which the financial distress was filed. For those who filed under chapter 7, they will have to wait for two years in order to have this form of financial help from a lender.

This is only done after the case has been dismissed. Those who have filed under chapter 13 will have to work much harder to pay their creditors so as to be allowed to borrow money. There are many lenders out there willing to lend money to desperate debtors. This may not be the only solution. It is important for the debtor to think this through before they can borrow.
