In 2008, we saw the beginning of a systemic meltdown of the world¡¯s economy, where even the relatively safe haven of diversification was not immune from the devastating effects of the markets¡¯ collapse. These tumultuous economic conditions have given rise to a dramatic increase in arbitration case filings. It is against this backdrop that arbitrators, mediators and administrators struggle to achieve fairness for parties. Additionally, despite decades of state and federal court rulings proclaiming arbitration as a forum of equity determined to achieve fairness, and judicial reluctance to second-guess arbitrators¡¯ decisions, the popular consensus seems to be that the process is unfair. It is this perception that fuels the demand that arbitrators and administrators either provide a fair forum for dispute resolution or provide no forum at all, allowing customers to choose litigation instead of FINRA arbitration.For this year¡¯s program we¡¯ve once again assembled a highly experienced faculty, including customer and broker attorneys, the FINRA Dispute Resolution Director of Arbitration and key members of his staff, expert witnesses and seasoned arbitrators who will discuss the unique challenges facing arbitrators, administrators, mediators and attorneys representing customers, brokers and firms in these uncertain times.
