This 2 ? day workshop is designed to improve on-the-job performance and decision-making for experienced HR professionals and employment law attorneys by utilizing an interactive learning approach to focus on actual workplace situations. Attendees analyze specific situations; evaluate the potential legal risks; weigh those risks against the needs and philosophy of their organization; and propose solutions to each identified problem. These workshops improve decision-making relating to HR risk assessment and control issues and topics. Workshops use: Factual situations addressed by the class as a whole; factual situations evaluated through small groups; hypothetical role playing; lecture to analyze hypothetical fact situations within the context of the law and; class discussion. A number of factual situations/case studies will be utilized, but one particular case study will be considered in several stages: investigation, analysis of the facts, application of the decision, and response to a legal challenge, culminating in the presentation of legal argument and trial testimony. Subjects will range across a variety of substantive areas, topics and decision-making issues including: 1) Analyzing hiring/discharge decisions in the context of potential discrimination, retaliation and wrongful discharge claims; 2) Evaluating ways to implement management changes without creating legal risk or substantial adverse employee response; 3) Dealing with FMLA, ADA and Workers' Comp situations; 4) Addressing behaviors at union and non-union locations that create the need for discipline; 5) Creating feasible performance feedback methods; 6) Managing employee/employer feedback and expectations resulting from surveys, compliance issues and audits; 7) Working to solve an array of employment-related issues.
