Bankruptcy Imprisonment- Dealing With The Emotional Stress

Author: Peter Gitundu

Personal bankruptcy can be filed due to many reasons, among them medical bills and mortgages. The filing can be done voluntarily or involuntarily. Whichever way it is done, it is important that some of the debtors questions are answered. Some people go into financial distress with so many unanswered questions and they end up making wrong choices.

Some people worry that once they have gone to court to file a personal bankruptcy petition, they might be imprisoned. The fact is that debtors imprisonment has been outlawed but this does not mean that there are no other ways in which debt can imprison an individual. In the past, both male and female debtors would be locked up in the same cell when they failed to pay their debts.

Many ended up dead before their families could pay up. This could be one of the major reasons why imprisonment for such people was done away with. Another important reason as to why people who fail to pay debts are no longer imprisoned is due to the fact that some people become insolvent for reasons that are beyond their control such as uninsured medical bills.

Personal bankruptcy might not lead an individual to jail but the emotional stress and strain that an individual goes through is more than any jail can give. Even when the court has discharged the debt, the debtor will continue feeling guilty over the fact that they were unable to pay creditors. Going to court might seem the best option there is when it comes to dealing with debt and creditors, but it is quite wise that the debtor fully exhausts other options. Debt may not lead one in a physical jail but the emotional torture is jail in itself.
